I, (hereinafter referred to as the ”Participant”), acknowledge that I am 18 years of age or older and am voluntarily participating in the Bonded Brotherhood Event/Activity (the ”Activity”) organized by Bonded Brotherhood. I understand that the Activity may involve physical exertion, outdoor environments, and inherent risks, including but not limited to bodily injury, property damage, or other losses.
1. Acknowledgment of Risks
I understand that the Activity involves risks, including but not limited to physical injury, illness, emotional distress, or death due to accidents, environmental hazards, equipment failure, or the actions of other participants. I acknowledge that these risks cannot be fully eliminated, and I knowingly and freely assume all such risks, whether known or unknown.
2. Assumption of Risk
I voluntarily assume all risks associated with my participation in the Activity. I certify that I am physically fit and have no medical conditions that would prevent my safe participation. I agree to follow all instructions, rules, and guidelines provided by Bonded Brotherhood staff or organizers.
3. Release and Waiver of Liability
In consideration of being permitted to participate in the Activity, I, for myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue Bonded Brotherhood, its officers, directors, employees, volunteers, agents, or affiliates (collectively, the ”Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the Released Parties or otherwise, while participating in the Activity.
4. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, liabilities, or expenses, including legal fees, arising from my participation in the Activity or any breach of this agreement.
5. Medical Authorization
In the event of an injury or medical emergency, I authorize Bonded Brotherhood to secure medical treatment on my behalf if I am unable to do so. I understand that I am responsible for all costs associated with such treatment.
6. Media Release
I grant Bonded Brotherhood, its representatives, and affiliates the irrevocable right to use, reproduce, publish, or distribute any photographs, videos, or other media recordings of me taken during the Activity for promotional, marketing, or other purposes, including but not limited to publications, websites, social media, and advertisements, without compensation or further consent.
7. No Licensed Mental Health Services
I acknowledge that Bonded Brotherhood, its staff, and its representatives are not licensed mental health therapists or medical professionals. Any activities, discussions, or interactions during the Activity are not intended to serve as professional mental health therapy, counseling, or medical advice. I understand that I should consult a licensed professional for any mental health or medical concerns.
8. Governing Law
This waiver shall be governed by and construed in accordance with the laws of the state in which the Activity takes place, without regard to conflict of law principles.
9. Acknowledgment of Understanding
I have read this Waiver and Release of Liability, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law.
